AGREEMENT & TERMS

“Owner” refers to James and Sons Tobacconists

As a condition of membership, I agree to the following terms:

All tobacco products consumed on the premises shall be purchased from the Owner
I am over the age of 21
The Owner reserves the right to cancel my membership should I be in violation of the Owner’s policies or for misconduct as determined by the owner
The Owner may change the terms of this agreement at any time. I will be notified of the change by email and/or posting in the store
Hours and days of membership access shall be posted, but may be changed by the Owner
Membership lounges or the entire store may be reserved by the Owner for functions by non-members. The membership shall be notified in advance by posting in the store
The Owner reserves the right to refuse service or access to the membership lounge to any person
Membership dues are payable upon signing this agreement. Membership dues are nonrefundable in whole or in part
Membership is not transferrable
Term / renewal. The initial term of this agreement shall be for a term of one year ( "Initial Term") commencing on the date this agreement is executed. At the expiration of the Initial Term, this agreement will renew for successive 30 day period unless a party provides the other parties with notice of its intent not to renew this Agreement at least ( 90 )days prior to the expiration of the current term.

In consideration for the Owner to approve my membership, I agree to the following:

I recognize that there exist certain risks associated with smoking. I freely assume personal responsibility for all known, unforeseen or unexpected risks. I waive all claims against the Owner by myself, my heirs and assigns

I agree to release and hold harmless and not to sue the Owner from and against all actions, demands, liabilities, suits, costs and expenses, including attorney fees, and claims for negligence arising from my use of the facilities or participation in any activities sponsored by the Owner. I agree to indemnify and pay for all claims the owner may bring against me or my family or guests.

I am solely responsible and will promptly pay for all damages incurred to the Owner’s premises by me, my relatives or my guests
